Image copyright notice and terms and conditions of use

Unless marked otherwise, the contents of this database, including photos and related metadata (“THW Photos”) are the property of Trash Hero World (“THW”). The metadata provided with each photo is an integral part of each photo. THW Photos may be used for scientific, educational or journalistic purposes to promote environmental awareness and to further the aims and work of THW, subject to the following terms and conditions:

1. THW grants to you (the “Licensee”) a worldwide, non-transferable, non-exclusive licence, royalty free, non-sublicensable right to access, view, download, use, reproduce, publish, display, broadcast THW Photos for a single use only, in print, digital and electronic form.  
2. Licensee may not sell THW photos, neither may Licensee include THW photos in a product that is sold, such as a book or film, without the express written consent of THW.
3. Copyright in THW Photos remains vested in THW, and THW retains all rights not specifically granted under these terms.
4. THW Photos shall be reproduced with the caption/title and used in the same context as described therein.
5. THW’s copyright will be acknowledged as follows: © Trash Hero World
6. THW Photos shall not be used in the following ways:
   • in connection with the promotion of a commercial enterprise and/or its product(s) or service(s); and/or
   • in any way that suggests that THW endorses any specific company or products; and/or
   • in any way which is contrary to the policies and principles of Trash Hero World (THW) and/or which might otherwise jeopardise the good works of THW, its programmes and/or its projects.
   • THW Photos cannot be sold, redistributed or used to create derivative works.
7. THW Photos shall not be altered or modified. Minimal cropping is permitted, as long as it does not change the interpretation of the image.
8. Licensee shall not use THW Photos in any manner which is or could be considered to be libellous or defamatory, or that in any way is or could be potentially unflattering or controversial for the subjects represented therein.
9. THW gives no representation, warranty, guarantee or undertaking that releases or consents which are required, desirable or necessary for reproduction have been or will be obtained whether in relation to the use of names, people, intellectual property rights or any underlying works of whatever nature depicted in THW Photos, or that any waivers of any moral rights have been obtained. THW Photos are distributed without warranty of any kind, either expressed or implied, and Licensee is entirely responsible for reproducing and displaying the material in their publication. In no event shall Trash Hero World be liable for damages arising from their use.
10. Indemnification: Licensee agrees to indemnify and hold THW harmless against any claim for damages, losses or any costs, including attorneys’ fees, arising in any manner whatsoever from your unauthorised use of the THW Photos supplied to Licensee by THW or for your breach of any of these terms.
11. In the unlikely event of any dispute arising in relation to the interpretation or application of these terms, that dispute shall, unless amicably settled, be subject to conciliation. In the event of failure of the latter, the dispute shall be settled by arbitration.
12. Nothing contained herein shall be construed as a waiver of any of the privileges and immunities enjoyed by THW under national or international law, and/or as submitting THW to any national court jurisdiction.
13. The depiction of specific companies or of certain manufacturers’ products does not imply that they are endorsed or recommended by THW in preference to others of a similar nature that are not mentioned.
